General terms and conditions of business

  • §1 Validity and definition of terms

(1) The following General Terms and Conditions apply to all deliveries between Snacker/Simon Alexander Johannes Korherr and a consumer in the version valid at the time of the order.

(2) Snacker/Simon Alexander Johannes Korherr reserves the right to amend/supplement/modify the Terms and Conditions at any time.

(3) By placing an order, the consumer (hereinafter referred to as the customer) declares that he has reached the minimum age required for this type of legal transaction and that the information he has provided is correct and complete.

(4) “Consumer” within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either his commercial or his independent professional activity.

(5) By submitting the order (see §2, paragraph 4) in this web shop, the customer expressly declares that these General Terms and Conditions have become part of the contractual content of the respective legal transaction in the version valid at the time of the order .

 

  • §2 Conclusion of a contract, storage of the contract text

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but rather provides non-binding information about the product range of Snacker/Simon Alexander Johannes Korherr. Due to the size of the online shop, no guarantee of any kind can be given regarding the current availability of the products presented here.

 

(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.

 

The order is placed in the following steps:

 

1) Selection of the desired goods

2) Confirm by clicking the “Buy now” button

3) Checking the information in the shopping cart

4) Press the “Check out” button

5) Re-examination or correction of the respective entered data.

6) Binding dispatch of the order.

Before submitting the order, the consumer can return to the website where the customer's details are recorded by clicking the "Back" button in the Internet browser they are using and after checking their details. They can correct any input errors or cancel the order process by closing the Internet browser. We will immediately confirm receipt of the order via an automatically generated email ("order confirmation"). This confirmation does not constitute a legally valid acceptance of the offer. Acceptance of the offer and thus the conclusion of the contract based on the placed order is expressly confirmed by a separate email to the customer or by notification (by email) of the successful dispatch of the ordered products.

 

(5) Storage of the contract text for orders via our online shop: We send the customer order details. The customer can view the General Terms and Conditions at any time at http://www.snacker.at/agb.html

 

  • §3 Prices, shipping costs, payment, due date

(1) The prices listed in the respective offers include all taxes. Delivery costs for shipping will be added to the stated prices.

In the event of erroneous prices (input errors), Snacker/Simon Alexander Johannes Korherr will immediately inform the customer of the correct prices. The customer then has the option of maintaining their order at the corrected price or withdrawing their order.

(2) The consumer has the option of paying the total price (purchase price plus delivery costs) via Visa, MasterCard, Maestro, Apple Pay, and Google Pay. We also offer eps Bank Transfer and Klarna Sofortüberweisung.

(3) The customer agrees to receive the invoice electronically by email.

  • §4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. The parcel will be dispatched within 7 working days at the latest.

 

  • §5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

 

  • §6 Contract language

The contract language is exclusively German.

 

§7 Right of withdrawal

Right of withdrawal

 

The customer has the right to withdraw from this contract within fourteen days without giving any reason. This does not apply to perishable products, such as Martin's Famous Potato Rolls. These products are exempt from the right of withdrawal.

 

The cancellation period shall be fourteen days from the day on which the customer or a third party other than the carrier designated by the customer takes possession of the goods.

 

In order to exercise his right of withdrawal, the customer must

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.

 

To comply with the cancellation period, it is sufficient for the customer to send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

 

Consequences of revocation

If the customer cancels this contract, we will refund all payments we have received from him, including delivery costs, promptly and at the latest within fourteen days from the date on which we received notification of the cancellation of this contract. For this refund, we will use the same means of payment that the customer used for the original transaction, unless expressly agreed otherwise with the customer; under no circumstances will the customer be charged any fees for this refund.

 

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

 

 

 

The customer must return the goods to us immediately and in any event no later than fourteen days from the date on which he informs us of the cancellation of this contract.

The customer shall bear the direct costs of returning the goods.

 

 

The customer only has to pay for any loss of value of the goods if this loss of value is due to handling by the customer which is not necessary to check the quality, properties and functioning of the goods.
